Welcome to Sailingmint Yacht Charter Agency ("we," "us," or "our"). By accessing or using our services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Booking and Reservations:
a. Sailingmint Yacht Charter Agency acts as an intermediary between fleet operators and clients. We facilitate yacht charters and reservations on behalf of clients.
b. All bookings are subject to availability and confirmation by the fleet operator.
c. Payment terms, cancellation policies, and other booking details are specified in the individual charter agreements.

3. Client Responsibilities:
a. Clients are responsible for providing accurate and complete information during the booking process.
b. Clients must adhere to the terms and conditions set by the fleet operator during the charter period.

4. Limitation of Liability:
We are not liable for any loss, damage, or injury arising from the use of chartered yachts. Clients are advised to obtain appropriate insurance coverage.

5. Intellectual Property:

All original content on our website, including text, logos, and unique images, is the exclusive property of Sailingmint Yacht Charter Agency and may not be used without permission. Certain images on the website are stock images, and their usage rights are subject to the respective licenses and terms provided by the stock image providers. Any unauthorized use of our original content is strictly prohibited.

6. Governing Law:​

a. These terms and conditions regarding the relationship between Sailingmint Yacht Charter Agency and clients are governed by the laws of the Republic of Poland.

7. Changes to Privacy Policy:

We reserve the right to update our Terms and Conditions, and any changes will be posted on our website.

Privacy Policy

1. Information Collected:


a. We collect personal information, including but not limited to, name, email address, phone number, and other relevant details provided by clients that are meaningful for the services provided (e.g. expressed interests, preferences constraints, and general questions).
b. Anonymous data may be collected through meta pixels to improve website usability, for example: information about user behavior, preferences, or site performance.

2. Use of Information:


a. Personal information is used for the following purposes:

i. Client Needs Assessment: We may contact clients to gather additional information about their preferences and requirements, enabling us to present suitable yacht options.
ii. Proposal Presentation: The personal information collected will be used to present proposals of available yachts that align with the client's needs and preferences.
iii. Booking and Reservation: Personal information will be used to facilitate the research for available yachts, as well as the reservation and booking of the selected yacht using the specific software designated for this purpose. 

iv. Contract and service implementation: To provide the yacht charter service,  personal data is required to perform the contract as well as data required by law (e.g. for identification on the yacht as a crew list). Personal data is processed for contract execution, financial settlement, to secure claims, and for archival and statistical purposes. You have the right to delete this data unless the law requires the storage of this data for purposes such as financial control.


b. Contact information might be requested by the fleet operator for the reservation and booking process:
i. Sometimes, the fleet operator requires the contact information of the client (usually e-mail). If that information is requested, to ensure the success of the reservation, we will share the e-mail contact with the fleet operator.
ii. If that is the case, we make reasonable efforts to ensure that the client's information is not used by the fleet operator for marketing purposes. However, we are not bound by the fleet operator's privacy policy.

c. We use marketing tools provided by Meta Platforms, Inc., located at Menlo Park, California, USA. These tools enable us to deliver targeted ads on Meta's platforms, driven by our legitimate interest in promoting our products and services:
i. The information gathered through Meta Pixel is anonymized, ensuring that we cannot personally identify you. We only gain insights into the actions you take while navigating our website, for example, which pages were viewed during your visit, or if you submitted the contact form.
ii. The data collected is often transmitted to and stored on a Meta server. It's important to note that Facebook may combine this data with other information collected during your use of their platform, using it for various purposes, including marketing. These Facebook activities are beyond our control, and you can find further details in Facebook's privacy policy: https://www.facebook.com/privacy/policy/ .  Additionally, you have the option to manage your privacy settings directly from your Facebook account.

b. Clients are responsible for maintaining the confidentiality of their account credentials.
